1. Contract
It is agreed that the following terms form the total contract between the parties and that no variation or modification of this contract shall be effective unless agreed in writing by Justin Goulding Photography and the client.
2. Deposit
A deposit of £250 is required to secure the booking, together with a signed contract. Dates are not reserved until this deposit is paid.
3. Balance
The remaining balance must be paid no later than six weeks before the date of the wedding/event.
4. Special Requests
Special requests are not binding contracts. While every effort is made to comply with the client’s requests, because of weather conditions and the willingness/availability of subjects, Justin Goulding Photography cannot guarantee that every request will be met.
5. Images
Although Justin Goulding Photography will endeavour to provide as many high-quality images as possible, there is no guarantee that any particular number of images will be provided. The images provided to the client will be decided solely by Justin Goulding Photography.
6. Supply of Images
Images will be provided in digital form. It is strongly advised that these are copied/backed up on at least one alternative device. Justin Goulding Photography cannot guarantee that images will be kept beyond the date of being supplied to the client.
7. Copyright
Under the 1998 Copyright, Designs and Patents Act, images supplied by Justin Goulding Photography remain the copyright property of Justin Goulding Photography. Justin Goulding Photography allows the client to store/share/print images for personal/family/friends use only. Images (digital or printed) cannot be used for financial or commercial gain.
8. Display
Justin Goulding Photography is permitted to use any images covered by this contract in portfolios, wedding exhibitions, advertising and marketing. Justin Goulding Photography will not use images covered by this contract for any other commercial reason, without the written permission of the client.
9. Cancellation
The client may cancel this contract at any time by giving written notice to Justin Goulding Photography, but all monies paid will be forfeited.
10. Limitation of Liability
In the unlikely event that Justin Goulding Photography has to cancel this contract for reasons beyond its control (death, illness, injury, act of God, act of terrorism), Justin Goulding Photography will make every effort to secure a replacement. If a replacement cannot be found, liability is limited to a full refund of monies paid for the contracted event.
In the unlikely event that all digital files are lost, stolen or destroyed for reasons beyond Justin Goulding Photography’s control (including but not limited to equipment or hard drive malfunction), Justin Goulding Photography’s liability is limited to a full refund of all monies paid for the contracted event.
In the unlikely event that some digital files are lost, stolen or destroyed for reasons beyond Justin Goulding Photography’s control (including but not limited to equipment or hard drive malfunction), Justin Goulding Photography’s liability is limited to a pro-rata refund of monies paid based on the percentage of total number of originals.
Neither Justin Goulding Photography nor the client is liable for indirect or consequential loss.
11. Privacy
Justin Goulding Photography will store your name and details on a private internal database. Your details will not be shared or made available to any companies outside Justin Goulding Photography.
12. Complaints
Please address any complaints to Justin Goulding Photography by email within 21 days of images being supplied to the client.
